18. GOVERNING LAW AND DISPUTE RESOLUTION
The provisions of this Agreement/Policy shall be governed by, and construed in accordance with Indian laws;
- 18.1 Arbitration
18.1.1 Any dispute, controversy or claims arising out of or relating to this terms or the breach, termination or invalidity thereof, shall be settled by arbitration in accordance with the provisions of the Indian Arbitration and Conciliation Act, 1996;
18.1.2 The arbitral tribunal shall compose of a sole arbitrator appointed by the company.
18.1.3 The place of arbitration shall be Mira road (Mumbai) and any award whether interim or final, shall be made, and shall be deemed for all purposes between the parties to be made in English.
18.1.4 The arbitral procedure shall be conducted in English language and any award or awards shall be rendered in English. The procedural law of the arbitration shall be Indian law;
18.1.5 The award of the arbitrator shall be final and conclusive and binding upon the Parties, and the Parties shall be entitled (but not obliged) to enter judgment thereon in any one or more of the apex courts having jurisdiction;
18.1.6The rights and obligations of the Parties under, or pursuant to this Clause, including the arbitration agreement in this Clause, shall be governed by and subject to Indian laws.
18.2 Notwithstanding the existence of any dispute, the Parties shall continue to perform their respective obligations under this Agreement pending resolution of the dispute without regard to the dispute, insofar as those obligations are not the subject matter of the dispute.
18.3 Notwithstanding the above, the Parties shall be entitled to approach the Court of appropriate jurisdiction before Thane / Mumbai for the grant of any interim or equitable relief.
